City Council Adopts Urgency Ordinance for Wireless Facilities in Public Right-of-Way


On March 26, 2019, the City Council adopted Ordinance 620, an Urgency Ordinance to regulate wireless telecommunication facilities in the public right-of-way (PROW).  In addition, Resolution 21-19 was passed to approve City Council policy for additional regulations applicable to small wireless facilities (SWFs) in the public right-of-way.  Significant changes in federal law implemented by the Federal Communications Commission (FCC) will become effective on April 14, 2019 which would otherwise limit state and local management of SWFs in the PROW. The City’s Urgency Ordinance adds a new Chapter 12.12 to the Morro Bay Municipal Code entitled “Wireless Telecommunications Facilities in the Public Right-of-Way.”  The proposed ordinance and design standards brings the City into compliance with laws governing wireless telecommunications facilities and allows the City to impose aesthetic and other design requirements on such facilities.
